Equity Guardians LLC (“Equity Guardians,” “EG,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit www.equityguardians.com (the “Site”), when you are offered or enrolled in the Equity Guardians program (the “Program”), or when you otherwise interact with us.
Equity Guardians is a home-equity protection service for homeowners. We are not a law firm and do not provide legal advice, and we are not a real estate brokerage. The Program is delivered through independently licensed attorneys, licensed real estate professionals, and an EG case manager who coordinates. This Policy works together with our Terms of Service and, for enrolled homeowners and partner real estate professionals, with the Member Service Agreement and the Partner Realtor Services Agreement.
1. Who This Policy Covers
This Policy applies to:
- homeowners who are offered or enrolled in the Program (“Members”);
- real estate professionals who partner with us (“Partner Realtors”); and
- visitors to the Site.
2. Information We Collect
Information you provide to us. Your name and contact details; the property address; information about your mortgage, loan servicer, and financial circumstances, including any financial hardship; information you share when you request help or communicate with us; and the consents and authorizations you give us.
Information we receive from Partner Realtors. When a Partner Realtor enrolls you, we may receive your contact information and details about your home purchase and closing needed to provide the Program.
Information from other third parties. We may receive information from mortgage servicers and lenders, from the independent attorneys who represent you, from curated savings and cashback partners, and from public records, in each case as needed to deliver the Program.
Information collected automatically on the Site. When you use the Site we may collect device and browser information, IP address, pages viewed, and similar usage data through cookies and comparable technologies.
3. How We Use Information
We use personal information to:
- deliver and coordinate the Program, including equity-building guidance, foreclosure protection, curated savings, realtor-led pre-foreclosure sale support, foreclosure recovery, and case management;
- connect you with an appropriate independent attorney and arrange payment of the attorney’s retainer through the Program;
- prepare and send the value-added correspondence (at least once each calendar quarter) on your Partner Realtor’s behalf;
- communicate with you and respond to your requests;
- operate, maintain, secure, and improve the Site and our services; and
- comply with legal, regulatory, and recordkeeping obligations.
4. How We Share Information
We share personal information only as needed to run the Program and operate our business, including with:
- the Legal Team, the independent attorneys who advise and represent you;
- your Partner Realtor, for the real estate services and attributed correspondence provided on their behalf;
- the Case Manager and EG personnel who coordinate your services;
- mortgage servicers and lenders, with your authorization, as needed to help with your loan;
- curated savings and cashback partners, to make offers available to you;
- service providers and vendors who support our operations under confidentiality obligations;
- legal and compliance recipients, when required by law, subpoena, or to protect rights and safety; and
- a successor in the event of a merger, acquisition, or sale of assets, subject to this Policy.
We do not sell your personal information.
5. Financial Information
Because the Program involves your mortgage and financial circumstances, we may collect and handle nonpublic personal financial information. We handle that information consistent with applicable financial-privacy law.
6. Marketing Communications and Your Choices
We (and, on their behalf, your Partner Realtor) may send you newsletters, educational content, and savings or discount offers.
Email. Every marketing email includes an unsubscribe link, consistent with the CAN-SPAM Act.
Text messages and calls. We contact you by text or automated call only with your consent; you may opt out at any time (for example, by replying STOP), consistent with the Telephone Consumer Protection Act (TCPA).
Essential messages. Even if you opt out of marketing, we may still send you service, transaction, and legally required messages.
7. Cookies and Tracking Technologies
The Site may use cookies and similar technologies to operate the Site, remember preferences, and understand usage. You can control cookies through your browser settings.
8. Data Retention
We retain personal information for as long as needed to provide the Program, which, for enrolled Members, generally continues for the life of the deed of trust, and afterward as needed for legal, regulatory, and recordkeeping purposes, after which we delete or de-identify it.
9. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Your Privacy Rights
Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, and to opt out of certain uses. Residents of certain states, for example California, Colorado, Connecticut, and Virginia, may have additional rights under state privacy laws. To exercise a right, contact us using Section 14. We will not discriminate against you for exercising your rights.
11. Children’s Privacy
The Site and Program are not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.
12. Third-Party Links and Services
The Site may link to third-party websites and services we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices.
13. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice.
