Please read these Terms of Service (the “Terms”) carefully. They govern your access to and use of www.equityguardians.com (the “Site”) and your general relationship with Equity Guardians LLC (“Equity Guardians,” “EG,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. Who We Are; What We Do
Equity Guardians is a home-equity protection service for homeowners. We are not a law firm and do not provide legal advice, and we are not a real estate brokerage. The Program is delivered through independently licensed attorneys, licensed real estate professionals, and an EG case manager who coordinates. EG itself does not practice law or perform real estate brokerage services.
2. Relationship to the Program Agreements
These Terms govern use of the Site and general matters between you and EG. The Equity Guardians program (the “Program”) itself is governed by separate written agreements, the Member Service Agreement (for homeowners) and the Partner Realtor Services Agreement (for real estate professionals). If these Terms conflict with one of those agreements as to its subject matter, that agreement controls for the parties to it.
3. Eligibility
You must be at least 18 years old and located in the United States to use the Site and the Program.
4. No Legal Advice; No Attorney-Client Relationship
Information on the Site and provided by EG is general in nature and is not legal advice. EG is not a law firm. Using the Site or the Program does not create an attorney-client relationship with EG or the case manager. Legal advice and representation are provided only by independent, licensed attorneys under a separate engagement between you and the attorney.
5. No Real Estate Brokerage by EG
EG does not perform real estate brokerage services. All real estate brokerage activity is performed by licensed real estate professionals acting within their license.
6. No Guarantee of Results
EG and the attorneys, real estate professionals, and partners in its network cannot and do not guarantee any particular result. Without limitation, we do not guarantee that a foreclosure will be prevented or postponed, that a loan will be modified or refinanced, that a home will sell at any particular price or time, that any specific savings or equity will be achieved, or any particular outcome for a homeowner or Partner Realtor. Past outcomes do not predict future results.
7. Third-Party Providers
The attorneys, real estate professionals, and savings and cashback partners involved in the Program are independent third parties. EG coordinates the Program but is not responsible for the acts, omissions, advice, or services of these independent providers, except as expressly stated in the applicable Program agreement.
8. Acceptable Use of the Site
We grant you a limited, revocable, non-exclusive license to access and use the Site for your own lawful, personal, non-commercial purposes. You agree not to use the Site unlawfully; interfere with or disrupt it; attempt to gain unauthorized access; collect or harvest data; infringe others’ rights; or misrepresent your identity or affiliation.
9. Intellectual Property
The Site and its content, and the Equity Guardians name, logo, and brand elements, are owned by EG or its licensors and are protected by law. We grant you a limited license to view the Site for the purposes above. You may not use our marks or content without our prior written permission.
10. Your Submissions; Electronic Communications
Information you submit through the Site is handled as described in our Privacy Policy. You consent to receive communications from us electronically, and you agree that electronic records and signatures are valid and enforceable under the federal E-SIGN Act and applicable state law.
11. Disclaimers
To the fullest extent permitted by law, the Site and all information and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, EG will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising out of or relating to the Site or these Terms. Nothing in these Terms limits any liability that cannot be limited under applicable law, including rights under applicable consumer-protection statutes.
13. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless EG and its officers, employees, and agents from third-party claims, losses, and reasonable expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.
14. Consumer Protection; No Waiver
Nothing in these Terms waives, or is intended to waive, any right or remedy you have under applicable consumer-protection law that cannot be waived.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
16. Termination
We may suspend or terminate your access to the Site if you violate these Terms or applicable law. Your participation in the Program is governed by the applicable Program agreement.
17. Governing Law & Venue
These Terms and any dispute arising out of or relating to them, the Site, or the Program are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The exclusive venue for any action or proceeding is the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts. This section applies regardless of where you reside or access the Site from, except where applicable consumer-protection law of your home state provides rights that cannot be waived by agreement.
18. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and EG regarding your use of the Site. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Neither party is liable for delays or failures caused by events beyond its reasonable control.
